As of March 1, 2021, for good and valuable consideration, the receipt and sufficiency of which is acknowledged, I (“the Participant”) hereby agree to and acknowledge the following:

1. These Terms and Conditions along with Payment of the Fee state the entire understanding between Script & Story Inc. (“Script & Story”) and the Participant with respect to my participation in the course/intensive (“Writing Through Play”). There is no other agreement, written or oral, express or implied, between Script & Story and me regarding my participation.
    

2. The “Fee” is the amount paid by the Participant to Script & Story paid via Script & Story’s website. Payment in full is required for official registration of the course, and is in U.S. dollars.
    

3. The Participant acknowledges that by participating in Writing Through Play that there is the possibility of personal injury due to the physical nature of the course. I do hereby waive, release and forever discharge Script & Story from any and all responsibilities or liability for any present and future injuries or damages resulting or arising from my participation in any activities. Knowing and reasonably anticipating that injuries are a possibility, I hereby expressly assume all of the risks of injury, all other possible risk of injury, and even the risk of possible death, which could occur by reason of my participation. Script & Story recommends that the Participant consult a physician prior to participating.
    

4. I understand that Script & Story may have already and/or may in the future receive or independently develop materials similar to materials or ideas expressed by the Participant throughout the duration of the course. The Participant will have no legal recourse, financial or otherwise, for the aforementioned developed materials, past, present or future. Any materials submitted to Script & Story with regards to the course shall remain the sole property of the Participant.
    

5. Course materials provided by Script & Story to the Participant are the sole property of Script & Story and may not be duplicated, replicated, reproduced, distributed or shared by any means. Participants who are in breach of this agreement may be subject to legal action.
    

6. I represent and warrant that I have the full and exclusive right to submit any materials to Script & Story for review.
    

7. Any feedback, comments and suggestions provided by Script & Story with regards to the course become the sole property of the Participant. In the event the Participant receives monetary compensation or royalties for their work during or following the course, Script & Story will have no interest, gain or rights to that financial compensation.
    

8. The Participant may not, under any circumstances, take photos, videos or screenshots, record any audio, or make virtual records by any means at any point during a live virtual Script & Story class. Photos, videos, audio recordings and screenshots may be taken by the instructor of the course, but only with advanced notice and explicit, written permission of all class participants.
    

9. The Participant agrees to the collection of use of the personal information in accordance with the Privacy Policy of Script & Story for the purpose of delivering and administering the course. Script & Story’s full Privacy Policy is available here: https://www.scriptandstory.com/privacy. In addition to receiving applicable Script & Story correspondence via e-mail or other electronic communication, the Participant expressly consents to receive any marketing correspondence from Script & Story upon registration in Writing Through Play. The Participant may unsubscribe from any such marketing lists without affecting access to Writing Through Play, or Script & Story’s other courses, intensives or services.
    

10. By purchasing Script & Story’s Writing Through Play course, the Participant hereby authorizes Script & Story to charge their credit card or other payment method automatically for the total amount of the course.
     

11. If a Participant is not satisfied with their purchase of Writing Through Play, the Participant can contact Script & Story via email or the contact form within 3 (three) days following the first day of the class the Participant has registered for providing the details of their complaint. Script & Story will evaluate the complaint and attempt to remedy the situation. If the Participant is still dissatisfied after Script & Story’s attempt to remedy the situation, Script & Story will provide a full refund to the Participant which will be processed within 5 business days via the original payment method. If Writing Through Play has to be canceled for any reason, Script & Story will refund the Participants in full by the original payment method.
     

12. The Participant acknowledges and accepts they may only attend the specific class they register for. For example, if the Participant registers for Mondays, the Participant may only attend the Monday classes. This is to provide our students with a safe, familiar space each week with the intention of building trust within the class and increasing comfortability. Therefore, the Participant acknowledges and accepts that there will be no make-up classes for any class missed.
     

13. Class attendance and participation will be the sole responsibility of the Participant. If the Participant does not attend or participate in the first class, or any classes hereafter, no refund will be provided.
     

14. By registering for Writing Through Play, the Participant confirms that they are over the age of 18.
     

15. I release Script & Story, its employees, contractors, agents, and anyone acting on its behalf, of and from any and all claims or causes of action of any kind, known or unknown, arising out of or relating to any materials. I agree that I will forgo making any claims or demands or bring any legal action against Script & Story in connection with the use or alleged use of any materials and expressly waive any and all such claims. I acknowledge that there may be facts relating or pertinent to the Terms and Conditions that I do not know or suspect to exist and I hereby waive my right to assert any claims arising from or relating to such facts.
     

16. In the event of any dispute concerning these Terms and Conditions, I hereby agree that I do not possess any remedy and will not seek actual damages and in no event will I be entitled to seek injunctive or other equitable relief. Any modification or waiver of the provisions of the Terms and Conditions must be signed by both a representative of Script & Story and me.
     

17. Script & Story is operated within the Province of Ontario, Canada. By accessing or using Script & Story, the Participant agrees that all matters relating to your access to or use of Script & Story and its content shall be governed by the laws of the Province of Ontario, and the federal laws of Canada applicable therein, without regard to conflict of laws principles. The Participant agrees and hereby submits and attorns to the exclusive jurisdiction of the courts of the Province of Ontario, with respect to all matters relating to their access to and use of Script & Story and all the courses, intensives and services therein.
     

18. Any personal and/or contact information received will not be shared or sold by Script & Story.

 

By registering for Writing Through Play, I hereby agree to the above Terms and Conditions.
